Types of AVOs in NSW

There are two main types of AVOs:

  • Apprehended Domestic Violence Orders (ADVOs) – applied where there is a domestic or family relationship

  • Apprehended Personal Violence Orders (APVOs) – applied in non-domestic situations (for example, neighbours, acquaintances or workplace disputes)

Both types of orders impose restrictions on a person’s behaviour and may include conditions that limit contact, communication or proximity to the protected person

What an AVO can do

An AVO may include conditions such as:

  • Not assaulting, threatening or intimidating the protected person

  • Not contacting the protected person directly or indirectly

  • Not approaching the protected person’s home or workplace

  • Restrictions on attending certain locations

  • Any other conditions the court considers necessary for protection

Breaching an AVO is a criminal offence and can result in arrest, prosecution and possible imprisonment.

What happens if an AVO is made against you

If an AVO application is made against you, you will usually be required to attend court. At this stage, you can:

  • Consent to the order being made (with or without admissions)

  • Consent without admissions

  • Oppose the application and defend the allegations

If you oppose the AVO, the matter may proceed to a defended hearing where evidence is considered by the court.
